Terms of Service

These Terms of Service ("Terms") govern your access to and use of MAV Rewards, the website at https://mavrewards.ca, the MAV Rewards mobile app, and the merchant portal (together, the "Service"), operated by Mini Mavericks ("MAV Rewards," "we," "us," or "our"). MAV Rewards serves two kinds of accounts under one Service: Customers, who earn and redeem MAV Medals, and Merchants, who issue Medals and offer rewards. Sections below apply to whichever role describes you; some apply to both.

By creating an account or otherwise using the Service, you agree to these Terms. If you don't agree, don't use the Service.

1. Eligibility & accounts

You must be able to form a binding contract to create an account. If you're creating a Merchant account, you must have the authority to bind the business you represent. You're responsible for keeping your account credentials secure and for all activity that happens under your account, including activity by staff you've given access to.

2. The MAV Rewards program

MAV Rewards is a shared loyalty network. Customers earn MAV Medals by shopping at participating Merchants and can redeem those Medals for rewards offered by any participating Merchant, not only the one they were earned from. Merchants issue Medals to Customers and set the rewards available in their own storefront within the marketplace.

3. Terms for Customers

  • MAV Medals have no cash value, cannot be sold or transferred between accounts, and cannot be exchanged for cash except where required by law.
  • Medals and claimed rewards may carry expiration windows, shown to you at the time they're issued or claimed. Expired Medals or rewards are forfeited.
  • We and participating Merchants may correct account balances to fix errors, reverse Medals issued or redeemed in error, or reverse activity connected to fraud or a violation of these Terms.
  • Merchants are independent businesses. We aren't responsible for the quality of goods or services a Merchant provides, or for a Merchant's failure to honour a reward, though we want to know if that happens, so please contact us.

4. Terms for Merchants

  • You're responsible for the accuracy of Medals you issue and for honouring rewards Customers redeem in good faith through the Service.
  • Paid plans, included Medal allotments, overage pricing, and billing intervals are described on our solutions page and in your merchant billing dashboard, and form part of these Terms once you subscribe.
  • Subscriptions renew automatically for the billing interval you choose (monthly or annual) until cancelled. You can cancel or change plans at any time from your billing dashboard; changes take effect at the end of the current billing period unless stated otherwise at checkout.
  • Payment processing for merchant subscriptions is handled by Stripe. We don't store your full payment card details.
  • We may suspend or terminate a Merchant's participation in the network for violating these Terms, misrepresenting rewards, abusing the Medal system, or failure to pay applicable fees.

5. Prohibited conduct

Whether you're a Customer or a Merchant, you agree not to, and not to permit anyone else using your account to:

  • Use profane, abusive, harassing, discriminatory, or threatening language or behaviour toward other users, merchant staff, or our team, whether in the app, at checkout, in reward descriptions, or in any communications related to the Service.
  • Commit fraud, including manufacturing, duplicating, or manipulating QR codes, Medal balances, redemptions, or issuance records, or misrepresenting a business to gain access to the merchant network.
  • Attempt to earn or redeem Medals through any means other than genuine transactions at participating businesses.
  • Reverse engineer, decompile, scrape, or attempt to gain unauthorized access to the Service, other users' accounts, or our systems.
  • Use the Service to send spam or unsolicited communications, or to post rewards, listings, or content that is illegal, deceptive, or infringes someone else's rights.
  • Use the Service for any purpose that violates applicable law.

We may suspend or terminate any account that violates this section, and may remove content or reverse activity connected to a violation.

6. Intellectual property

The Service, including its design, branding, and software, is owned by Mini Mavericks or its licensors and protected by intellectual property law. These Terms don't grant you any rights to our trademarks or branding beyond what's needed to use the Service as intended.

7. Disclaimers

The Service is provided "as is" without warranties of any kind, to the fullest extent permitted by law. We don't guarantee that the Service will be uninterrupted, error-free, or available at all times, or that any particular reward or Merchant will remain part of the network.

8. Limitation of liability

To the fullest extent permitted by law, Mini Mavericks won't be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of Medals, rewards, profits, or data, arising from your use of the Service. Our total liability for any claim relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or $100 CAD.

9. Termination

You can stop using the Service and close your account at any time. We may suspend or terminate your access to the Service if you violate these Terms, or for any other reason with reasonable notice where practical. Sections that by their nature should survive termination (including Prohibited Conduct, Intellectual Property, Disclaimers, and Limitation of Liability) will survive.

10. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll update the "Last updated" date above and, where appropriate, notify you through the Service. Continued use of the Service after changes take effect means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict-of-law principles.
